The phrase 'beyond historicism' is usually associated with Bielefeld historians like Hans Ulrich Wehler and Jürgen Kocka, who attempted to turn the study of history into a social science, but a better candidate would be the sociologist Niklas Luhmann, who happened to teach as well in Bielefeld during the 1970's and 1980's. Luhmann had little affinity with the project of his colleagues from the history department. He took the opposite view that the social sciences suffered from a naive enlightenment view (...) and should become more history minded. Like the historicists of the early nineteenth century Luhmann was indirectly inspired by the philosophy of Leibniz. Although Luhmann's theory of social systems may seem miles away from the daily interests of most historians, it can be interpreted as an Aufhebung of historicism. This will be demonstrated for two important concepts, the autopoietic system which incorporates the historicist notion of individuality and the concept of second order observation which can be read as an abstract redescription of what historicists meant by the historical method. To address the burden of maternal morbidity and mortality in low‐ and middle‐income countries (LMICs), research with pregnant women in these settings is increasingly common. Pregnant women in LMIC‐context may experience vulnerability related to giving consent to participate in a clinical trial. To recognize possible layers of vulnerability this study aims to identify factors that influence the decision process towards clinical trial participation of pregnant women in an urban middle‐income setting. This qualitative research used participant observation, in‐depth interviews, and focus (...) group discussion with medical staff and pregnant women eligible for trial participation, at a regional hospital in Accra, Ghana. Besides lack of familiarity with modern scientific concepts, specific factors influencing the decision‐making process were identified. These include a wide power difference between health provider and patient, and a different perception of risk through externalization of responsibility of risk management within a religious context as well as a context shaped by authority. Also, therapeutic misconception was observed. The combination of these factors ensued women to rely on the opinion of the medical professional, rather than being guided by their own motivation to participation. Although being a (pregnant) woman per se should not render the label of being vulnerable, this study shows there are factors that influence the decision process of pregnant woman towards trial participation in a LMIC context that can result in vulnerability. The identification of context‐specific factors that can create vulnerability facilitates adaptation of the design and conduct of research in a culturally competent manner. (shrink)

This article considers Hugo Grotius’s ideas on a specific topic of commercial law, analysing his position and potential contributions to early modern Dutch insolvency legislation. It might be questioned how ‘Hollandic’ Grotius’s interpretations of legal solutions for insolvency as presented in the Inleidinge tot de Hollandsche Rechts-Geleerdheid actually were. Grotius’s treatment of cessie van goede is relatively strict, whereas compositions are hardly mentioned. A rather different image rises from his later work. Here, Grotius displays a more radical view, in specific (...) cases allowing the sovereign to interfere in private property rights and to restructure debts for the common good. It is an intriguing question if and to what extent these ideas can be related to contemporary Dutch insolvency practices. (shrink)

ABSTRACTThe metaphor of historical distance often appears in discussions about the study of contemporary history. It suggests that we cannot see the past in perspective if we are too near to it. According to founding fathers like Ranke and Humboldt, temporal distance is required to discern historical “ideas” or forms. The argument may have some plausibility, but the presupposition is plainly false, since we cannot see the past at all. This leaves us with the question of what to make of (...) the so‐called historical forms. This article discusses three different views. The first, historicist, view is objectivist and localizes historical forms in the past. The second, narrativist, view is subjectivist and localizes historical forms in the realm of imagination and representation. The third view goes beyond the other two in that it considers both sides. It does not use a one‐sided but a two‐sided concept of form, which hinges on the idea of a distinction. This means that historical forms occupy both sides of the subject–object distinction or the present–past distinction. Because the subject–object terminology is confusing, the essay employs an alternative distinction between first‐ and second‐order observation. With the help of this distinction, it is possible to redescribe the distance metaphor in such a way that the theoretical status of contemporary history becomes less enigmatic. (shrink)

The destruction of the temple in Jerusalem by the Romans in AD 70 was an unquestionably traumatic event in the history of the Jewish people. By all accounts it was a social, political, and theological disaster. As such, contemporary Jewish figures wrestled with the meaning of the event. This article analyses the efforts by two figures in this internal Jewish dialogue to provide this meaning, namely, the historian Josephus and Jesus of Nazareth. We will see that in both cases the (...) meaning of the destruction was rooted in the firm conviction of the God of Israel’s existence and his self-revelation in Scripture. The temple was destroyed not apart from God or in spite of God, but in full accordance with his will. This will, moreover, was judged to be accessible through Scripture, both in terms of its prophetic value and its establishment of a metanarrative – redemptive history – that provided a framework for historical events. In addition, the reason for the destruction was judged by both to be the sins of (certain) people. The major difference between them lay rather in the question of which sins exactly were judged to be responsible. (shrink)

This paper looks at some of the ways in which environmental philosophers have sought to press ecological concepts into the service of environmental ethics. It seeks to show that although ecology plays a major role in opening our eyes to sources of value in the natural world, we should not necessarily attempt to build our account of nature’s value upon the concepts which ecology supplies. No description is going to capture nature’s essence; no formula is going to demonstrate its value. (...) We should recognise the natural world as a particular historic individual and relate to it accordingly. This means acknowledging its value in a contingent, conditional and provisional way, and recognizing its value as a precondition of the value of our own lives. (shrink)

Even in the Netherlands, where the practice of physician-assisted death (PAD) has been legalized for over 20 years, there is no such thing as a ‘right to die’. Especially patients with extraordinary requests, such as a wish for PAD based on psychiatric suffering, advanced dementia, or (a limited number of) multiple geriatric syndromes, encounter barriers in access to PAD. In this paper, we discuss whether these barriers can be justified in the context of the Dutch situation where PAD is legally (...) permitted for those who suffer unbearably and hopelessly as a result of medical conditions. Furthermore, we explore whether there are options to address some of the barriers or their consequences, both within the Dutch legal framework or by adjusting the legal framework, and whether these options are feasible. We conclude that although there are insufficient arguments to overrule the doctor’s freedom of conscience in the Netherlands, there are ways to address some of the barriers, mainly by offering support to doctors that would be willing to support a request. Moreover, we believe it is morally required to reduce or mitigate where possible the negative consequences of the barriers for patients, such as the long waiting time for those who suffer from psychiatric disorders, because it is unlikely the adjustments suggested to the system will ensure reasonable access for these patient groups. Recent investigations on how people derive meaning from language have focused on task‐dependent shifts between two cognitive systems. The symbolic (amodal) system represents meaning as the statistical relationships between words. The embodied (modal) system represents meaning through neurocognitive simulation of perceptual or sensorimotor systems associated with a word's referent. A primary finding of literature in this field is that the embodied system is only dominant when a task necessitates it, but in certain paradigms, this has only been demonstrated using nouns (...) and adjectives. The purpose of this paper is to study whether similar effects hold with verbs. Experiment 1 evaluated a novel task in which participants rated a selection of verbs on their implied vertical movement. Ratings correlated well with distributional semantic models, establishing convergent validity, though some variance was unexplained by language statistics alone. Experiment 2 replicated previous noun‐based location‐cue congruency experimental paradigms with verbs and showed that the ratings obtained in Experiment 1 predicted reaction times more strongly than language statistics. Experiment 3 modified the location‐cue paradigm by adding movement to create an animated, temporally decoupled, movement‐verb judgment task designed to examine the relative influence of symbolic and embodied processing for verbs. Results were generally consistent with linguistic shortcut hypotheses of symbolic‐embodied integrated language processing; location‐cue congruence elicited processing facilitation in some conditions, and perceptual information accounted for reaction times and accuracy better than language statistics alone. These studies demonstrate novel ways in which embodied and linguistic information can be examined while using verbs as stimuli. (shrink)

It is sometimes held that rules of inference determine the meaning of the logical constants: the meaning of, say, conjunction is fully determined by either its introduction or its elimination rules, or both; similarly for the other connectives. In a recent paper, Panu Raatikainen argues that this view—call it logical inferentialism—is undermined by some “very little known” considerations by Carnap (1943) to the effect that “in a definite sense, it is not true that the standard rules of inference” themselves suffice (...) to “determine the meanings of [the] logical constants” (p. 2). In a nutshell, Carnap showed that the rules allow for non-normal interpretations of negation and disjunction. Raatikainen concludes that “no ordinary formalization of logic [... ] is sufficient to ‘fully formalize’ all the essential properties of the logical constants” (ibid.). We suggest that this is a mistake. Pace Raatikainen, intuitionists like Dummett and Prawitz need not worry about Carnap’s problem. And although bilateral solutions for classical inferentialists—as proposed by Timothy Smiley and Ian Rumfitt—seem inadequate, it is not excluded that classical inferentialists may be in a position to address the problem too. Modality is a category of linguistic meaning having to do with the expression of possibility and necessity. A modalized sentence locates an underlying or prejacent proposition in the space of possibilities. Sandy might be home says that there is a possibility that Sandy is home. Sandy must be home says that in all possibilities, Sandy is home. The counterpart of modality in the temporal domain should be called “temporality”, but it is more common to talk of tense and aspect, the (...) prototypical verbal expressions of temporality. Together, modality and temporality are at the heart of the property of “displacement” that enables natural language to talk about affairs beyond the actual here and now. (shrink)

This paper presents a sequential search model where consumers look for several products and multiproduct …rms compete in prices. In such a multiproduct search market, both consumer behavior and …rm behavior exhibit di¤erent features from the single-product case: a consumer often returns to previously visited …rms before running out of options; and prices can decrease with search costs and increase with the number of …rms. The framework is then extended in two directions. First, by introducing both single-product and multiproduct searchers, (...) the model can explain the phenomenon of countercyclical pricing, i.e., prices of many retail products decline during peak-demand periods. Second, by allowing …rms to use bundling strategies, the model sheds new light on how bundling a¤ects market performance. In a search environment, bundling tends to reduce consumer search intensity, which can soften competition and reverse the usual welfare assessment of competitive bundling in a perfect information setting. Theory Reduction in the Social Sciences. The example of balance theories. A central topic both in philosophy of science as well as in the empirical sciences is the reconstruction of the relations between theories. In the past comparisons of theories by means of traditional linguistic methods have proved to be extremely difficult and complicated. In this article the reconstruction of intertheoretical relations based on model-theoretical terms is propagated, as formulated within the structuralist view of theories. The efficiency of a model (...) theoretical based comparison of theories is demonstrated by two theory elements from the social science research program of balance theories: The basic element by Heider and the transitivity theory by Holland and Leinhardt. First of all both theory elements are introduced informally and reconstructed in the structuralist format. On the basis of these reconstructions can be shown, that the Heider theory can be formally reduced to the Holland-Leinhardt theory and that the theory younger in history means an improvement. However, an integration of all balance theoretical elements into a theory net is not possible. (shrink)

ABSTRACT Because of the existence of severely defective humans it is commonly held that whatever consideration is due to all humans is also due to many other animals, and that therefore speciesism, or the readiness to prefer the interest of humans to those of other animals, is unjustified. After criticism of this reasoning a ‘naturalised’ speciesism, acknowledging, for example, the affinities between species, is articulated and defended. A key to this defence is the separation of the task of specifying morally (...) significant differences between humans and other animals from the task of justifying the extension of consideration to defective humans. The conclusion is that more traditional vices than speciesism are chiefly to blame for the shabby treatment of animals by humans. (shrink)

J.H. van den Berg was a member of the Utrecht school of phenomenology that flourished in Holland during the 1950s and early 1960s. He was a psychiatrist who had a private practice and he taught at the University of Leiden. Along with other members of the Utrecht school, not all of whom were psychiatrists, he was among the first to apply the insights drawn from existential-phenomenological philosophy to psychology and psychiatry. As with the philosophers, he emphasized that subjectivity was engaged (...) with the world and its activities had to be described. He emphasized that insights into experience as lived, or the phenomenal level, was what was critical for psychologists to understand. (shrink)

This essay poses the question whether it is possible, given the relationship of a subject and the method of its examination, at present as opposed to the time when Savigny worked, to talk about the same subject, and if it is not, what are the consequences for the interpretation of law. The turbulent history of Europe in the 20th century, marked by the cataclysms of world wars, genocides, expulsions and upheavals, therefore the necessity of new beginnings, jointly with other factors (...) (e.g. technological optimism) resulted not only in the ebbing of influence for religion, morality and tradition, but also in a deconstruction of law. This includes fragmentation, loss of the ability to formulate and interpret the purpose of law, as well as relativization of the traditional ordering principles of law (particularly the non-contradiction condition and contextual consistency, hierarchical structure, relative stability of law and its language). The opening of the texture of law, its deconstruction, creates a new segment of legislation, namely judicial law-making arising from the uncertainty of normative premises. (shrink)

I don't think the statement was meant to imply anything about the patient; if anything, it may have been included for context to prepare me for (...) the patient's intermittent absence. But, reading this, I felt a familiar sense of annoyance rising in my chest. Every few months, I take care of a patient who seems to never be in his room. The patient is consistently out smoking, in the cafeteria, or in another unknown location, seemingly doing an undisclosed activity. This is frustrating because it means I have to work around the patient's schedule of smoke breaks and jaunts to the cafeteria to evaluate the patient on a daily basis. The thoughts inevitably cross my mind: Does this patient even want care in the hospital if he's never in his room? Is he actually sick enough to need to be in the hospital if he's able to spend so much time outside of the hospital? Why is he leaving so frequently—is he doing drugs?This particular patient had been in perfect health until two months before I met him when he was shot multiple times during an encounter at a gas station. One of the bullets had lodged in his back, shattering a vertebra. Another had decimated the bones in his right upper arm, which were now held in place by screws and plates. Several had landed in his abdomen, necessitating the removal of part of his bowel. Finally, a bullet had sliced through the lower part of his right kidney, shredding his ureter and mandating surgical reconstruction of his urinary system. After over a month in the intensive care unit with multiple reparative surgeries, he was discharged to a rehabilitation facility. But he started having fevers and fast heart rates; ultimately, he was admitted to the hospital again for multiple infected fluid collections that had formed at the sites of his surgeries. He left the hospital prior to getting treated for these infections, purportedly "against medical [End Page 12] advice." And now, several weeks later, he was here in the hospital for the same reason.The first time I went to see Mr. H, he was, of course, not in his room. I went to the nursing station to ask if the clerk knew where he was. She knowingly said, "Oh yeah, he goes out a lot. I can give him a call to let him know the doctor is here to see him if you'd like." I assented, thanked the clerk for calling him, and proceeded, annoyed, in seeing the rest of my patients. I considered how I would address Mr. H's behavior when I was finally able to talk to him. I had seen others take many different approaches—negotiation about the timing and frequency of these extramural expeditions, ultimatums about getting discharged, mandating urine drug screens upon return, and silent, frustrated tolerance. I resolved to wait to speak to him to determine which approach might be most suitable. An hour later, I received a call from the clerk that Mr. H had returned to his room to see me.The first time I met Mr. H, he informed me he had taken the bus to midtown to make a run to the grocery store. I was internally incredulous. He felt well enough to go to the grocery store? Why was he in the hospital then? At that moment, I opted not to discuss his frequent departures yet, as I was frustrated and realized I wouldn't be able to identify the best way to address them. I reviewed his medical issues with him, asked specific questions about how he was feeling, performed a physical exam, and reiterated his current plan of care. Was Malthus a ‘Utilitarian’? This apparently simple-minded question is justified by on-going debate in the secondary literature. For example, in his study, The Classical Economists, D. P. O'Brien maintains that ‘only the two Mills, apart from Bentham himself, were really Utilitarians’. Against this we have the view of Lord Robbins that ‘We get the picture badly out of focus if we conceive that reliance on the principle of utility was confined to Bentham and his immediate circle.’ In this paper we (...) shall demonstrate the justice of the Robbins perspective with specific reference to the population issue. Christopher Cherry's article in the January 1973 issue of this journal has on its first page the sentence ‘And when a philosopher writes that “no clear idea is available to us of what moral scepticism amounts to”, that moral scepticism would, if it were possible at all, have to be a “specially cooked-up affair” by contrast with other varieties of scepticism, it is hard not to accuse him of just such a vice.’ He means the vice of disingenuousness and the (...) person to whom he attributes it is me. I did not write what he says I wrote and neither of his quotations is accurate. On the next page Cherry claims again to be summarizing a view of mine when he says that ‘An “intellectual moral scepticism” would, if it were anything, have to be a peculiarly cooked-up affair, and so by implication different from other forms of intellectual philosophical scepticism. It has come to be expected that collections issued by the Royal Institute of Philosophy will contain work that has quality or is otherwise interesting. This volume runs true to form and presents plenty of both.
